I am part of a group of individuals that are members of the Linux Open Source Patents Association. While most of us are Linux professionals, many of us are not, but we are all interested in this group.
While I’m not in the group with the same interests, it’s still a good group to belong to. Many of us are already familiar with the issues of IP protection that has come up in the Linux community as it relates to copyright law. We are trying to come up with a solution to this problem and are working to create a group that can help provide that solution.
The most basic of all problems is the lack of proper copyright enforcement. IP rights holders have created copyrights and used them as a tool for enforcing their rights. However, there’s no way to enforce a copyright that includes your name and photos without a court order. Because copyright is not enforced properly, it is easy to create an intellectual property lawyer and have them create legal threats that are meaningless to a company that wants a piece of the action.
The problem with this is that there are plenty of companies willing to take advantage of the system. In fact, if you are a company that wants to do something with the copyrights, you are almost certainly going to get hit with a lawsuit. Its like going after a cop in the morning and then seeing a cop walking out of your front door in the afternoon. However, there are things that you can do to fight back.
A few weeks ago I tried to get into an online patent rights group. I was told that I had to send my lawyer’s name and address to keep me in. Now, if I had had to send my lawyer’s name and address to keep me in, I probably wouldn’t be sitting here right now. However, the point is that it doesn’t matter if you are a company, a government, or even an individual, if you have a patent you can protect.
Well, the point is that theres no reason not to. And the internet is full of people who need to be able to defend themselves. While there are a lot of reasons not to have to pay for the privilege of protecting your own invention, there are a lot of reasons to protect it. The group that I am talking about, is called Linux Patent and Trademark Office. It is the only free online patent office that lets you join for a cost. This is a great idea because it provides a way for all people to learn about the laws, regulations, and rules that govern what you can and cannot protect. At the same time, it provides a place to learn how to protect your invention.
This group does actually get a lot of questions about protecting your ideas and inventions, and so we thought we would have a forum here to answer them. The idea behind Linux Patent and Trademark Office is to provide a free online forum for people who have an idea or invention that they believe is worthy of patent protection. The site does not actually provide you with money to pay for protection; instead you are given a site that will provide you with free protection.
With the Linux Patent and Trademark Office you can get free protection for your invention, but only if you are willing to put the burden of proof on someone who just claims to have an idea or invention, and only if you are willing to put the burden of proof on someone who is just saying that it is a “good idea.” This does sound like a burden of proof, but the purpose is not to prevent others from trying to make money out of your idea.
The purpose of the Linux Patent and Trademark Office is to provide a neutral, fair, and open source environment so that anyone can use anything they invent, and so that everyone can have a fair chance of success. This sounds like a good idea.
